Big pharma is currently fighting to maintain intellectual property protections over COVID-19 vaccines, with Australia refusing to act despite having no pharmaceutical companies.

The Australian government is under increasing pressure to follow the lead set by the United States and New Zealand and publicly support moves to temporarily waive patents on COVID-19 vaccines in order to allow developing countries to make and sell cheap copies.

Despite the pandemic, the COVID-19 vaccines are owned by big pharmaceutical corporations that, as it currently stands, are refusing to share their science and know-how to enable mass production.

The World Trade Organisation (WTO) is currently pushing for a temporary waiver of intellectual property rules during the COVID-19 pandemic, as proposed by South Africa and India.

As it currently stands, 120 nations, including China and Russia, support wavering the 1995 WTO-instated 20-year patent provision that protects the IP rights for newly produced vaccines with the goal to achieve a quicker end to the global pandemic.

But, and despite not being home to a COVID vaccine manufacturer, the Morrison government has yet to sign the permit waiver.

Speaking to nestegg, ActionAid Australia’s executive director, Michelle Higelin, urged the government to do more. Ms Higelin argued that current rules only serve the interest of big pharmaceutical companies and act against the survival of millions of people who urgently need a vaccine.

“The Australian government said in answer to Senate estimates questions last week that it has not decided whether to support the temporary waiver on WTO rules to share intellectual property on vaccines, treatments and equipment, despite saying that it is open to this,” she said.

Academics urge the government to act

While the Morrison government remains slow to act, pressure from lawyers and advocacy groups is starting to lift, with many fearing the government is behaving under the influence of big pharma.

A group of 150 Australian lawyers and legal scholars have signed an open letter urging Prime Minister Scott Morrison to back the waivers.

The open letter, organised by La Trobe academic Dr Julia Dehm, highlighted how Australia is helping the world fall further behind on treatment.

“The longer it takes for the global population to be vaccinated and achieve herd immunity, the more likely it is that further COVID-19 outbreaks will threaten Australia’s relative security and prosperity. Approximately 11 billion doses of COVID-19 vaccines are needed to vaccinate 70 per cent of the world’s population and achieve population-level or herd immunity.

“To date, the World Health Organisation approximates that 1.2 billion doses have been administered.

“Based on current trajectories, mass immunisation in poorer countries could take until 2024 or longer,” Dr Dehm said.

People and not profits

Amnesty International Australia and a number of other civil society groups, including GetUP, have collected 50,000 signatures for the petition, which was personally delivered to DFAT’s Sydney office on Monday.

Tim O'Connor from Amnesty International said the petition urges the Australian delegation at this week’s WTO meeting to take a leadership role and openly support the proposal on the patent waiver.

“Amnesty International is calling on the Australian government to stop blocking the TRIPs waiver and not put big pharma ahead of people,” he said.

“Australia has a vital role to play in the equal access of vaccines, particularly in our region. We want Australia to be the good global citizen when it comes to promoting and defending human rights, especially in the time of COVID-19.”

Paul Oosting, GetUp national director, said the PM must stand with the people.

“It’s abhorrent that Australia is one of 12 member states blocking this life-saving proposal,” he said.

“The COVID-19 vaccine waiver is more than just intellectual property – it’s a matter of life and death.”

Aussies are being offered half-price flights as the government looks to spur domestic travel to regions it has defined as key to economic recovery.

As of this morning, the government’s $1.2 billion tourism stimulus package has kicked in, offering 800,000 half-price flights to popular tourist spots across the country.

According to RMIT associate professor Chrystal Zhang, the stimulus package may vary significantly, ranging from just above $100 to over $500, one way, as airlines look to maximise the margin on each seat.

“Likely, only a limited number of half-price fares will be available for travel in the immediate few weeks after they go on sale, as airlines have justified grounds to optimise revenue,” Ms Zhang said.

Travellers are said to have the best chance of getting a cheaper fare if they travel later in the eligible time frame (July, August and September), but avoid school holidays and weekends.  

“Bargain hunters should look at routes like Darwin to Cairns, Adelaide to Gold Coast and Avalon to Gold Coast, with one-way fares likely to drop $50 to $80,” Ms Zhang said.

Her RMIT colleague, Dr James Gilchrist Steward, doesn’t believe the airlines will move to inflate their prices, with the ACCC said to keep a watchful eye.

However, with the end of JobKeeper coming at the same time as these cheap airfares, there’s a possibility accommodation providers and tourism operators may increase their pricing. 

“The bigger question here is whether day trips, equipment hire and food and beverage suddenly get more expensive as tourism operators are desperate, especially as autumn and winter can be quiet at the best of times. Worst-case scenario is a $4 beer could cost $12,” Dr Gilchrist Steward said.

Moreover, the most recent COVID-19 outbreak has echoed that holidays are in fact a lot more complicated given the risk of border closures.

“Every airline, accommodation and tourism operator have their own terms and conditions – meaning if there’s a lockdown or similar, consumers must unravel multiple contracts for one holiday.  

“The constant threat of border closures, like we are seeing with the Brisbane outbreak, may result in contractual frustration – where the contract can’t be completed as it’s out of everyone’s control,” said Dr Gilchrist Steward.

The current government-nominated routes include the Gold Coast, the Sunshine Coast, Carins, the Whitsundays and the Mackay region in Queensland.

Also on the map are Uluru and Alice Springs in the Northern Territory, the Tasmanian towns of Launceston, Devonport and Burnie, WA’s Broome, Avalon near Melbourne, Merimbula in NSW and SA’s Kangaroo Island.

The Australian Competition and Consumer Commission (ACCC) found that government-imposed lockdowns, which limited non-urgent elective surgery and non-urgent extra treatments, saw the cost to insurers fall compared with 2019 costs. 

At the same time, average premium increases have continued to be higher than inflation and wage growth despite the fact that most insurers postponed their scheduled April 2020 premium increases for at least six months in response to the pandemic.

“The ACCC expects insurers to act on public commitments to return any profits gained from COVID-19 to policyholders, including through hardship measures such as premium waivers and discounts, and through the timely management of any built-up demand for non-urgent elective surgery,” ACCC deputy chair Delia Rickard said.

The report also noted that health insurance participation rates had continued to decline over the past year, as the proportion of the population holding “hospital only” or combined cover fell from 44.3 per cent in June 2019 to 43.6 per cent in June 2020.

“The overall decline in the proportion of people with hospital policies in 2019-20 was possibly due in part to the economic slowdown associated with COVID-19. However, some have asserted that the pandemic also reminded Australians of the quality of Medicare and the Australian hospital system, leading them to question the value of continuing to pay for private health insurance,” Ms Rickard said.

“While it is difficult to determine the exact reason why there was a lower proportion of people with hospital cover in the year ending June 2020, there is little uncertainty about the continued downward trend, particularly among younger age groups.”

The report from the ACCC follows data released by the Australian Prudential Regulation Authority (APRA) which showed that younger Australians are not signing up for new premiums due to the high costs associated with insurance. 

According to the latest APRA data, the number of people aged 20 to 29 with hospital cover and general health insurance has dropped by 8 per cent and 5 per cent, respectively, over the past three years.

Despite charging more for claims and paying out less, APRA has found profits for the sector fell over the year.

Industry net profit after tax of $0.9 billion and return on net assets of 3.2 per cent were significantly lower during the year ended September 2020.  

This was due to lower underwriting results from the catastrophic bushfire and storm events in late December/early 2020, and large falls in investment income mainly from the negative impact of the COVID-19 pandemic on investment markets in the March quarter.

ASIC has commenced civil penalty proceedings in the Federal Court against the Commonwealth Bank over the bank charging an interest rate on business overdraft accounts that was substantially higher than what customers were advised.

ASIC has alleged that from 29 December 2011 to 31 March 2018, CBA charged more than 2,200 customers a different, higher interest rate than they were advised on their overdraft accounts, accumulating to an overcharged total exceeding $2.9 million.

The rate, which customers were advised would be 16 per cent per annum in most cases, was said to rocket to around 34 per cent per annum.

The customers had been advised otherwise in terms and conditions the bank provided for certain credit facilities and in periodic account statements referencing the rate at which interest was being charged.

CBA allegedly attempted to manually fix the overcharging error after a complaint was made to the bank in 2013.

The manual fixes were unsuccessful, and customers continued to be overcharged.

ASIC also claimed that from 1 December 2014 to 31 March 2018, being within the six-year limitation period, CBA engaged in conduct that contravened financial services laws.

Specifically, that on 12,119 occasions, CBA was said to: make a misleading representation in contravention of s12DB(1)(g) of the ASIC Act; engaged in misleading or deceptive conduct, or conduct that was likely to mislead or deceive, in contravention of s12DA(1) of the ASIC Act; and failed to comply with its obligation to comply with financial services laws in contravention of s912A(1)(c) of the Corporations Act. ASIC is seeking declarations, pecuniary penalties and other orders against CBA.

The date for the first case management hearing is yet to be scheduled by the court.

CBA’s conduct was the subject of a case study by the Hayne royal commission.

The bank has set up a remediation program that has so far compensated $4 million to the customers impacted in the case.

ASIC previously obtained a $5-million penalty against CBA for failures of its AgriAdvantage Plus Package, which included, among other things, overcharged interest on loans and fees.

Logistical issues and currency fluctuations caused by the COVID-19 pandemic has seen the most expensive cities in the world drastically change, new research has revealed.

Paris and Zurich have joined Hong Kong in becoming the three most expensive cities in the world, according to the latest Cost of Living Index from the Economist Intelligence Unit (EIU).

The index compared the prices of 138 goods and services from some 130 cities in September 2020 and found that prices on average grew 0.3 per cent over the past year.

The European cities have leapfrogged over Singapore and Osaka, which tied with Hong Kong in the previous survey conducted in March.

The changes are due to the COVID-19 pandemic, which has seen prices fluctuate around the world.

Currency fluctuations due to the pandemic means destinations in Africa, the Americans and Eastern Europe became less expensive since March, while Western Europe, where the Euro has risen in value against the US dollar have seen price rises.

A mass exodus of foreign workers has seen Singapore fall to fourth in world rankings, while Osaka has fallen with Tel Aviv now tying for fifth place.

Geneva, New York City, Copenhagen and Los Angeles round out the top 10.

Sydney is now the 15th most expensive city, while London ranked 20th in the world.

Largest cost of living rises

While Paris and Zurich are the most expensive cities in the world, the biggest cost-of-living increases were in Tehran and Perth.

 

The index showed the cost-of-living in Perth increased compared with other major cities as the Western Australian capital climbed 12 places to 67th most expensive city in the world.

Only Tehran made a bigger leap up the ladder – climbing 27 rungs to 79th place due to the reduced supply of goods (and subsequent price increases) caused by US sanctions.

Costly cigarettes, cheap clothes

While the prices of packaged goods, such as coffee, cheese, rice and orange juice, rose across most cities in the latest worldwide cost of living survey, the average index for the food and grocery category remained flat.

Logistical challenges also affected prices, with shortages of goods such as toilet roll and pasta fuelling price rises in some categories.

Of the 10 categories covered by the report, tobacco and recreation saw the biggest price increases, while clothing prices have seen the steepest decline.

The mean index for tobacco reported the highest year-on-year increase for any non-durable goods. 

All five Australian cities saw double-digit increases in the tobacco index.

A Sydney financial adviser has pleaded guilty to misappropriating $2.9 million in his clients’ funds.

On 17 November 2020, Ross Hopkins from Northern Sydney suburb Seaforth appeared at the Downing Centre Local Court, where he pleaded guilty to 15 offences and was committed to the Sydney District Court for sentence.

ASIC’s case against Mr Hopkins alleged that between 14 October 2016 and 8 October 2019, as the sole director of advice firm QWL, he made 167 unauthorised transactions for 13 clients amounting to $2.938 million.

The regulator alleged the misappropriated funds were transferred into Mr Hopkins’ own personal accounts, or accounts otherwise controlled by him, and used for his own benefits.

ASIC also alleged that he made false representations about the nature of the unauthorised transfers to conceal his dishonest conduct and avoid detection.

QWL, which has held its AFSL since 2004, provided financial advice including dealing in securities and advising on self-managed superannuation funds.

ASIC commenced an investigation into Mr Hopkins and the company in 2019, in response to allegations that QWL had failed to assist AFCA in resolving client complaints.

On 4 November 2019, ASIC obtained orders and undertakings restraining Mr Hopkins and QWL from dissipating assets or providing financial services to clients.

On 18 November 2019, the regulator obtained an extension of those orders until 25 May 2020, with a further extension obtained until 23 November.

Following ASIC’s investigation, Mr Hopkins was charged with dishonesty offences and then entered into an early guilty plea. Mr Hopkins has been granted conditional bail.

The matter has been adjourned to the Sydney District Court for mention on 18 December. 

The Commonwealth Director of Public Prosecutions is prosecuting the matter following a referral by ASIC.
