In an online article, SuperConcepts executive manager, SMSF technical and private wealth, Graeme Colley said that receiving an audit report for a breach of the superannuation standards can be very upsetting in an already upsetting time, so it is very important that the right processes are followed to reduce the risk of this occurring.  

Mr Colley explained that regulation 6.21 of the SIS Regulations makes it difficult for the trustee of an SMSF to pay lump sums and be compliant at the same time.

“This regulation states that on a member’s death, a compulsory condition of release has taken place which requires benefits to be paid as lump sums and/or a pension,” Mr Colley said.

“For lump sums, the payment can be made as one amount or as an interim lump sum plus a final lump sum.”

Where it can become challenging, he cautioned, is that under section 58 of the SIS Act, it is possible for the deceased member to direct the trustee to transfer parcels of shares or other fund investments to the beneficiary or their legal personal representative — and the trustee is required to comply with the direction.

“Each cash payment, investment or parcel of investments, such as company shares, that are transferred are required to be treated as a separate lump sum,” Mr Colley said.

As an example, Mr Colley said a member may have directed the trustee to transfer certain investments in-specie other than in cash to the beneficiary or the trustee may have exercised their prerogative and transferred some fund assets to a beneficiary or the deceased member’s estate.

“If the death benefit consists of more than two lump sums such as a couple of cash payments and the transfer of a number of investments, then the requirements of regulation 6.21 would be breached,” he warned.

With auditors paying greater attention to funds complying with the legislation, Mr Colley said there are many more issues being raised with trustees.

“In some situations where trustees and their advisers are conscientiously sticking to the rules, they end up with solutions that weasel around the law to comply with the payment of death benefit lump sums,” he said.

“This is being done by death benefit pensions commencing and making a number of lump-sum commutations. The only trap here is that commencement of the death benefit pension may run into trouble with transfer balance cap issues.”

Mr Colley said he would like to see a practical approach provided in the legislation for the compulsory payment of lump-sum death benefits to take multiple lump sums into account.

“This would be preferable to forcing trustees to fall back on an artificial solution such as multiple lump-sum commutations of death benefit pensions,” he noted.

“For integrity purposes, maybe the legislation could be amended so that a time limit be placed on death benefit lump sums subsequent to the member’s death.”

As a guide, Mr Colley said it is generally accepted in the industry that a period of six months after the member’s death is reasonable to pay lump sums or commence pensions and meet the requirement in regulation 6.21 that the death benefit has been “paid as soon as practicable”.

“If the benefit cannot be paid within six months, then late payment of the benefit needs to be supported by providing a reasonable excuse,” he reminded advisers.

“The delay on the basis of a reasonable excuse could be due to challenges to the benefit payment, the appointment of a legal personal representative or other significant reasons.”

Mr Colley said the payment of superannuation death benefits is in need of an overhaul because of the manner in which lump sums can be paid from the fund.

“A change which would result in multiple lump sums being paid within a set period would overcome the technical traps that now exist and inadvertently lead to breaches of the SIS regulations,” he said.

These are people whose interstate or overseas jaunts have been thwarted by closed borders, or who have been freed from the nine-to-five grind and want to take the “work from anywhere” concept literally. However, while adventuring sounds fun, it doesn’t always generate a secure income. Consider some good financial planning so you can enjoy the nomadic life and still maintain financial security.

Before the trip

The options for how to stretch finances depends on your specific circumstances. It’s important to see a financial planner early on in this process, but there are a few general tips I can offer.

Reduce debt. Pay it down as much as you can and see if consolidation makes sense. Do not carry credit card debt into this adventure.

Plan your income and expenses. Income sources include savings, investment dividends, long service leave, redundancies, ongoing business, or profits from asset sales. Plan expenses, including buying your start-up gear. Many nomads budget for $1,000 per week, but it varies. Once you know how much you’ll need, you can start planning where to take the funds from.

Interrogate your tax and maximising options. If you’ve received a lump sum and want to use it to kick-start your nomadic life, there may be some tax-efficient ways to stretch this amount. Consider various strategies, including a variety of superannuation strategies, consider paying down debt and investing in the name of the partner who didn’t earn an income, or earned less.

Time your trip to suit your finances. Are there are any benefits to going this or next financial year based on your circumstances? 

Get your financial foundations in place. There are a few things you’ll need to get right as a basis for any secure financial future. These include having an emergency fund, creating a spending plan, getting the right insurances, optimising all aspects of superannuation including fees and investments inside, and having an up-to-date estate plan. 

On the trip

Now you’ve hit the road and money is flying out the door and not so much is flying back in. 

Review your tax. With the income changes, there may be tax incentives you are now eligible for. You could make a spousal superannuation contribution, which will reduce your tax bill. You may also be eligible for the Family Tax Benefit. 

Manage your income streams. Are you relying on income from dividends, term deposits that pay interest or rental income? Should you be? Any income linked to investments can change. Make sure you have enough money parked somewhere to see you through. 

Spend less money. It sounds obvious, but in my experience, people spend what they have. I’ve had clients go from spending $200,000 per year to $40,000 after switching to a nomadic life for a year. When you aren’t in the ‘rat race’, you’ll be surprised how much joy life gives you for free and all the expenses you no longer have.

Use the nomad community. Experienced nomads will tell you their biggest expense is usually fuel. Find the cheapest with apps like Fuel Map Australia. Second to fuel is accommodation. WikiCamps Australia is one of many apps that has information about sites, including where the free ones are.

Packing up and hitting the road does not have to cripple you financially. If you set yourself up right and plan well, you could have the adventure of a lifetime while you’re young, fit and healthy and return to a solid financial foundation.

Heffron head of SMSF technical and education services Lyn Formica explained that while death benefits need to be dealt with as soon as practicable, what this means exactly will depend on the circumstances of your client and their superannuation fund.

“Many non-SMSFs will find it relatively easy to make payment of a death benefit within only a few months if it is fairly straightforward to identify all the potential beneficiaries,” Ms Formica said.

“For SMSFs, the ATO’s general rule of thumb is that six months should be long enough to pay most lump-sum death benefits or get death benefit pensions in place. However, for many SMSFs, the process will take longer than six months.”

The important part, she said, is ensuring the SMSF trustee has valid reasons for any delay beyond six months, which could include taking time to seek specialist advice or taking time to determine the validity of any death benefit nominations.

It is also vital that SMSF trustees document those reasons together with why they are still considered within the “as soon as practicable” time frame, she added.

“While it can take time to sell illiquid assets such as properties or investments in unlisted entities, SMSF trustees should bear in mind that they were required to consider the liquidity needs of the fund in the event of benefits needing to be paid when setting the fund’s investment strategy,” she noted.

“For this reason, we understand the ATO will generally not accept long delays in the payment of death benefits due to liquidity needs without other extenuating factors.”

For most SMSFs, Ms Formica said a lump-sum death benefit can be paid by transferring an asset directly to a beneficiary at its market value rather than making a cash payment.

“While this is not without its challenges, it is an option to consider if it is difficult or undesirable to sell the assets for some reason,” she said.

“Note that an in-specie transfer would be considered a disposal of the asset by the fund for capital gains tax purposes, and an acquisition of the asset by the beneficiary for stamp duty purposes – this means an in-specie transfer is generally not a way to avoid any such costs.”

Nerez Grant sued her mother’s estate because her mother’s will did not provide “adequate provision for  proper maintenance, education or advancement in life”.

The NSW Supreme Court confirmed that the decision as to whether to make a family provision order in favour of the daughter, Ms Grant, would be a two-stage process – first, you decide if what she has received is adequate, and if not, then, second, you work out what would be.

However, key witnesses said Ms Grant was not a loving child despite telling the court she was, with her brother stating otherwise.

According to Townsends Business & Corporate Lawyers principal Peter Townsend, the NSW Succession Act gives the court the power to determine what is adequate, including the power to refuse to make any order even though the applicant has shown the will to be inadequate. That is particularly so where there is evidence of mistreatment of the deceased by the child applying for more of the estate.

“The court should accept that the deceased… is entitled to make no provision for a child, particularly in the case of one who treats their parents callously, by withholding, without proper justification, their support and love from them in their declining years. Even more so where that callousness is compounded by hostility,” Mr Townsend said. 

Ms Grant failed in her claim for provision out of her mother’s estate. The court held that her ill treatment of her parents, particularly her mother, over a long period disentitled her to any further relief by way of family provision.

“Mrs Grant was afraid of her daughter Nerez Grant with good reason. Nerez behaved with callous brutality towards both of her parents over decades… Nerez treated her mother as a creature to be frightened and then coerced into doing what she wanted. Any vestiges of mother-daughter affection had long disappeared between Nerez and Mrs Grant. 

“Stung by the constant pain of Nerez’s drug taking, thefts, aggression, unpredictability and the shame she brought upon the family, Mrs Grant’s decision to keep her daughter at arm’s length was entirely understandable,” Mr Townsend concluded.
