According to the ASFA, only one per cent of self-managed superannuation funds (SMSFs) with balances over $3 million have farm-related income, suggesting the new tax would have a negligible effect on the agricultural community. However, the SMSF Association has highlighted serious flaws in this argument.

Peter Burgess, the SMSF Association's CEO, expressed skepticism towards ASFA's findings: “The simple fact is farming properties can be held under myriad tax structures, so using personal tax return data to extrapolate the number of farming properties that which may be impacted by this proposed law is not valid,” he contended. He also pointed out that “ATO income tax return data has limited application for substantive data analysis due to the way the tax return data is collated and reported.”

The concern for the SMSF Association centres not just on farms, but across the wider SMSF sector, with Burgess noting, “Individual tax returns are an unreliable data source from which to draw inferences on the asset holdings or liquidity of SMSFs.” Despite the lack of precise numbers of farms held in SMSFs, the National Farmers Federation suggests that more than 30 percent of Australian farms could be in an SMSF, which according to Burgess, is "a common vehicle used by Australian farm businesses to manage assets and use agricultural land to provide retirement income."

Burgess highlighted the complications for farmers who may be affected by the proposed tax, considering the cyclical nature of farming income and the impracticality of relating the value of assets to taxable income, especially during years impacted by extreme events like droughts, floods, or fires. He added, “This limits the ability to make concessional super contributions or to personally pay tax assessed on the value of superannuation fund assets, which can rise in value despite their personal circumstances.”

The Association is also challenging the idea that SMSFs will have sufficient liquidity to pay the proposed tax, specifically rejecting the claim that compliance with market rate income regulations for SMSF assets would mitigate liquidity concerns. Burgess explained, “Many farming properties historically generate low income yields so the land value is not a good indicator of the level of lease income,” and further argued, “increases in property values do not always equate to an increase in lease income.”

The implications of the proposed tax are potentially serious, with research by the University of Adelaide indicating that the tax could negatively impact up to 50,000 SMSF members. Burgess warned of the variable nature of tax liability due to the inclusion of unrealized capital gains in the tax, which can make liquidity management extremely challenging.

He concluded with a stark message about the proposed tax: “The tragedy of this proposed tax is that it’s a solution looking for a problem. The fact is the ability to attain significantly high balances in superannuation will be inhibited by existing policy settings." Burgess emphasised the existence of other measures that already limit individuals' capacity to contribute to their superannuation funds, reflecting a comprehensive approach to managing high balances already in place.

The statistics have begun to change coming out of the COVID-19 pandemic, according to new findings from Australian Investment Exchange Limited (AUSIEX).

The Australian provider has reported that SMSF growth has continued following the peak of the pandemic. However, most notably the shift has moved from self-directed to advised clients with a particular spike coming in September 2021.

According to AUSIEX, the advised book is 51.3 per cent of all SMSF accounts, the self-directed segment makes up 43.9 per cent and the remaining 4.8 per cent is attributed to advised wrap platform accounts.

“Self-directed investors who not long ago had the time to set up and manage the compliance obligations and direct their investments, may be finding themselves facing both challenging investment conditions and time poor once again,” AUSIEX CEO Eric Blewitt said.

“As a consequence, they may now be again seeing the value in and actively seeking professional advice.

“Advised clients are a distinct group within SMSF accounts and have regained ascendancy over new self-directed SMSF accounts in the second half of 2021.

Advised SMSF clients are far more likely than self-directed SMSF clients to trade ETFs and are also more bullish on AREITs, hybrids and exchange-traded physical commodities.”

Meanwhile, the number of millennial-advised SMSF clients has quadrupled in the last ten years, while females accounted for 28 per cent of new advised principal contact SMSF clients as at February 2022.

The figure is an impressive spike, given females made up just 18.5 per cent of new advised clients in 2012.

The findings come after this month’s SMSF Association 2022 national conference, where CEO John Maroney urged trustees to be cautious of technology changes in the sector.

Speaking at the event, Mr Maroney said that technology advances will benefit the sector, however, they “will be evolutionary, not revolutionary” and that “any change must benefit the SMSF trustee”.

“The building blocks for a strong integration between technological change – I include Artificial Intelligence (AI) in this – the advice community and trustees are in place, and now we must focus on maximising the benefits for both the industry and trustees,” he said.

A new survey has suggested that Gen Z are just as likely as Baby Boomers to have a self-managed super fund.

Young people are now taking control of their super investments as much as older generations with a new eToro survey finding that 47 per cent of Aussies aged under 35 currently have a self-managed super fund (SMSF).

Around 45 per cent of Gen Z respondents were found to have an SMSF, equal to the uptake among Baby Boomers, and 76 per cent of these Zoomers said they had created their SMSF within the past five years.

Two-thirds of Aussies aged under 35 with an SMSF said they had been building their fund for between one and five years.

“Despite stereotypical perceptions, Millennials and Gen Z Aussies are increasingly taking their superannuation and finances into their own hands,” said eToro Australia MD Robert Francis.

“They are realising the importance of investing younger than their parents - many as soon as 18 - in order to put themselves in an advantageous position for a comfortable retirement.”

A third of the young Aussies surveyed believed that they could get a better average return managing their super themselves compared to a traditional super fund.

Most young people said they were focused on generating a diversified SMSF portfolio, including 84 per cent of Millennials and 75 per cent of Gen Z.

The SMSF portfolios of Millennials were predominantly filled with stocks (60 per cent), crypto (43 per cent) and property (41 per cent).

Meanwhile, Gen Z respondents were more likely than Millenials to hold stocks (72 per cent), crypto (64 per cent) and property (50 per cent) in their portfolio, but both younger generations held less property than those aged over 45 (54 per cent).

For Millennial stock investors, the local share market is preferred (45 per cent) to the US (32 per cent), in contrast to Gen Z stock investors who favoured the US markets (47 per cent) ahead of the ASX (29 per cent).

Both generations highlighted tech, energy, real estate and financials as their top sectors, along with specific preferences of healthcare for Millennials and materials for Gen Z.

eToro said that young investors tended to shy away from investments with a higher perceived risk such as CFDs, options and FX.

The biggest barriers cited by those who don’t have an SMSF included not knowing where to begin, not knowing how an SMSF works and preferring someone else to manage their super on their behalf.

36 per cent of Millennials said they contributed between $5,000 and $10,000 to their SMSF annually while 50 per cent of Gen Z contributed between $1,000 and $5,000.

Only 16 per cent of those aged under 35 contribute more than $10,000 to their fund per year.

SMSFs are competitive with APRA-regulated superannuation funds, new research has suggested.

New research released on Tuesday (15 February) by the University of Adelaide revealed that the investment performance of a typical self-managed super fund (SMSF) improves as the fund balance approaches $200,000.

This, the SMSF Association said in a statement, disproves current regulatory guidance by reinforcing an earlier finding that SMSFs with balances of $200,000 or more are cost-effective compared with industry and retail superannuation funds.

The SMSF Association, which commissioned the report based on a study of over 318,000 SMSFs, said the research quashes ASIC’s guidance to advisers and licensees that suggested that, on average, SMSFs with balances below $500,000 have lower returns after expenses and tax than funds regulated by APRA.

“The research data revealed no material differences in performance patterns for SMSFs between $200,000 and $500,000, so the notion that smaller SMSFs in this range deliver materially lower investment returns, on average, than larger SMSFs in this range, is not supported by the research results,” said John Maroney, the association’s chief executive.

“The research results suggest a more appropriate threshold is $200,000”.

Mr Maroney believes these new findings are “a very significant development for the SMSF sector”.

Commenting on the report, Professor Ralf Zurbruegg from the University of Adelaide explained that the method used by the ATO to calculate SMSF performance significantly differs from that used by APRA to measure the effectiveness of its own funds.

“When we account for the differences in how the performance of these funds is calculated, neither APRA regulated superannuation funds nor SMSFs with balances above $200,000 consistently under or out-perform each other,” Professor Zurbruegg said.

Moreover, the new research found that SMSFs with more diversified asset allocations achieve higher returns.

“The performance benefits of adding a second, third or fourth asset class are strong and consistent across the 2017-19 period,” Mr Zurbruegg said.

“The results provide a useful reference point and education tool for SMSF professionals and investors and supports the regulatory focus on SMSFs with inadequate levels of diversification.”

Legal disputes are on the rise when it comes to trusts and self-managed super funds.

While more and more Aussies are looking to take control of their financial future, they’re making the same mistakes and afoul of the same pitfalls.

According to Equity Trustees national manager for estate planning Marie Brownell, the rise in DIY or off-the-shelf trusts has come hand-in-hand with a rise in legal wrangles for those involved.

“Australians are a nation of DIY fanatics but trusts are complex legal structures and not something anyone should create without specialist legal advice,” she said.

Ms Brownell bemoaned the reality that it was all too common for accountants to offer clients of an off-the-shelf trust when asked for advice on minimising tax, rather than a more bespoke option that has been properly drafted for a client’s needs and circumstances.

While there are many good reasons to consider establishing a trust, it’s important to do it right.

“In order to establish a trust that is suitable for your current and changing circumstances, as well as those of your loved ones, always get proper legal advice, ensure you have a good succession plan for who is going to control the trust on death or incapacity and never sign anything you don’t understand,” Ms Brownell recommended.

Taking shortcuts here can yield courtroom headaches in the long run.

Ms Brownell noted a similar set of dynamics at play when it came to Australia’s burgeoning self-managed super fund sector.

“As a result of the proliferation of SMSFs in Australia, we are seeing more SMSFs challenging trust decisions as a result of trustees acting negligently, incompetently or even fraudulently,” she said.

As with trusts, it’s critical that those looking to set up a self-managed super fund understand the rules they’ll need to comply with.

Ms Brownell warned that many of those who choose to go the SMSF route forget that superannuation death benefits do not automatically fall into the estate for distribution in accordance with the will. 

“In the absence of a binding death benefit nomination, the trustee of the fund will decide who gets the benefit,” she explained.

Another point that’s often overlooked is how that trustee is determined.

“If it’s someone who stands to benefit themselves, in a manner contrary to your wishes, then you need to carefully consider what steps you need to take to ensure your death benefit is paid as you intend,” she suggested.
