A nationwide crackdown on incidents of fraud involving the creation of fake businesses to scam GST refunds from the federal government has led to the Australian Taxation Office (ATO) firmly warning Australians not to engage with these shady businesses.

The ATO claims that $850 million is being spruiked on social media, and has launched Operation Protego, which is probing potentially fraudulent payments made to about 40,000 Australians who have each claimed on average around $20,000.

According to the ATO, the scam involved offenders setting up sham businesses and ABN applications, then submitting bogus Business Activity Statements to receive a false GST refund.

The ATO said it’s presently working with banks, the Reserve Bank (RBA) and an AUSTRAC-led collaboration between law enforcement and financial industry bodies to crack down on the organised scam.

ATO deputy commissioner and chief of the serious financial crime taskforce, Will Day, said that information on how to attempt the fraud is being shared online including via social media platforms.

“We are working with social media platforms to help remove content promoting this fraud, but if you see something that sounds too good to be true, it probably is” Mr Day said.

He warned that the people who have participated in this fraud are “not anonymous”.

“We know who they are, and we will be taking action."

He urged anyone involved to “face the music” and come forward now rather than face even tougher consequences later, including penalties and criminal charges.

“Unfortunately, as we take action to protect revenue, some legitimate taxpayers may find they have to take extra steps to receive their legitimate refunds as we have put extra controls in place as a result of this fraud. But we must emphasise that the fraudsters are not real or legitimate small businesses” Mr Day said.

“People who have participated in this fraud may have unwittingly followed advice they have read online, claiming to help access a loan from the ATO, or receive other financial government support such as a disaster payment."

“However, for others, there was nothing accidental or unintentional about setting up a fake business in their own name and seeking an unearned refund."

“Circumstances where there were deliberate attempts to defraud the ATO or a refusal to organise repayments will lead to tougher actions including criminal action.”

More than 549 million scam phone calls have been blocked since the introduction of new rules for telcos in late 2020, according to the data from the Australian Communications and Media Authority (ACMA).

The Reducing Scam Calls Code is among the initiatives developed by ACMA and the telecommunications industry in response to the agency’s Combating Scams Action Plan.

The code requires telcos to detect, trace and block scam calls as well as publish information to assist their customers manage and report scam calls, share information with other telcos and report identified scam calls to authorities or face penalties of up to $250,000.

“Every scam call that doesn’t reach a consumer is a good outcome, and every initiative that helps disrupt scammers makes Australia a harder target and increases confidence in our telecommunications services,” ACMA chair Nerida O’Loughlin said on Tuesday.

Research conducted by ACMA last year found that 98 per cent of Aussie adults have received unsolicited communications on their phone.

Around 86 per cent of Aussies said that they received scam calls and four out of ten said they received these calls on at least a weekly basis.

In the first quarter of this year, scam call complaints were down by 70 per cent for ACMA and 49 per cent for the Australian Competition and Consumer Commission’s Scamwatch.

“We will be actively monitoring to see if this trend continues. Given the agility of scammers, we need to exercise some caution about shorter-term trends,” Ms O’Loughlin noted.

New rules introduced in mid-2020 have also resulted in a 95 per cent decrease in reports of mobile porting fraud, with ACMA anticipating a similar reduction in SIM-swap scams when new rules come into effect on 30 June.

Scamwatch reported that financial losses associated with phone scams increased by 61 per cent in the first quarter of 2022 compared to a year earlier, rising from about $20 million to $33 million.

Ms O’Loughlin said that the industry needed to prioritise the development of new rules to block SMS scams following a 331 per cent increase in financial losses during the first three months of the year to over $4 million.

She also called on the telco industry and the financial sector to work together to share data, and said that telcos needed to continue to build their capability to identify and block scams and provide more information to their customers about how to identify and stop scam calls.

“Combating scams is a seriously challenging business, and while we are having some wins, set-and-forget industry efforts and regulatory obligations are not going to effectively address the problem,” said Ms O’Loughlin.

“It is only by continued strong collaboration across government, the telco industry, the financial sector that we will keep succeeding.”

The tax office said that scams involving TFN and ABN applications are on the rise in the lead up to tax time.

Taxpayers have been warned to be on the lookout for fake websites that purport to provide tax file numbers (TFN) and Australian business numbers (ABN).

The ATO said that it had seen an increase in scams involving fake services that offer to obtain a TFN or an ABN for a fee but do not actually provide the promised service.

Instead, these scams, which are often advertised on social media, steal both money and personal information from affected individuals.

“We are concerned about a recent increase in the number of victims reporting scams around TFN and ABN applications,” said ATO assistant commissioner Tim Loh.

“We are also still seeing scammers impersonating the ATO, making threats, demanding the payment of fake tax debts or claiming a TFN has been ‘suspended’ due to fraud.”

More than 50,000 people reported ATO impersonation scams during 2021 alone with victims losing over $800,000 in total.

The ATO noted that it was “free, quick and easy” for individuals to apply for a TFN via its own website and to apply for an ABN through the Australian Business Register.

Additionally, the tax office said that those who apply for a TFN or ABN through a tax agent should ensure that the tax agent is registered with the Tax Practitioners Board.

“Scammers are constantly developing new ways to target the community, and we expect to see more of these malicious attempts to steal identity details in the lead up to tax time,” said Mr Loh.

“We are encouraging everyone to be on alert and take the time to remind family and friends to be on the lookout and stay safe online, so you don’t fall victim to a scam this tax time.”

To avoid scammers, the ATO urged taxpayers to know their tax affairs and check whether they have a legitimate debt by logging into myGov or calling their tax agent.

Individuals should ensure that the website or phone number is accurate and legitimate and not engage with any call, text or email that they are uncertain about.

This includes only giving out personal and financial information to trusted people and remaining careful when clicking on links, downloading files or opening attachments.

The ATO said that taxpayers should also understand the legitimate ways to make payments, as scammers can lure victims into paying fake debts via unusual methods such as gift cards or bank accounts that are not linked to the tax office.

Anyone who believes they or someone they know may have fallen victim to a scam should contact the ATO as soon as possible via 1800 008 540 or the ATO’s website.

The ABS previously reported that more than 723,000 people, or 3.6 per cent of the population, experienced some type of scam during the 2020-21 financial year.

The bank said it would block suspect transactions from overseas online retailers that are considered high-risk of being a scam.

Westpac has announced it has begun automatically blocking online transactions from detected overseas retailers that are highly likely to be scammers.

A trial conducted by the bank last year involving diet pill retailers blocked more than 11,000 potential scams for 4,000 of its customers and saved over $1.2 million.

After expanding the scam blocks to more online retailers in January, Westpac said that it had stopped 69,000 more customers from losing over $6 million, or an average of $87 each.

“Online shopping scams are on the rise and we’re seeing more overseas retailers targeting Australians with false advertising for popular products like diet pills, supplements, dating subscriptions and business services,” said Westpac chief executive consumer & business banking Chris de Bruin.

“With our research showing these scams are costing Australians hundreds of millions each year, we’re ramping up our investment in technologies which will help detect scams and prevent customers getting swindled.”

Westpac estimated that expanding the block would stop an additional 2,000 of its customers each day losing a collective $120 million each year.

When the bank detects a scam following an online credit or debit card payment, it will automatically block the transaction and notify the affected customer by SMS.

If the customer believes the transaction is legitimate and wishes to proceed, they are able to contact Westpac’s scam assistance team.

However, the bank said that over 99 per cent of customers did not go ahead with transactions after receiving a scam alert.

“We want to help put a stop to online scams by blocking retailers who may be misrepresenting what they’re selling or duping Aussies into handing over money for products they’ll never receive,” said Westpac head of fraud Ben Young.

“The technology adds another layer of security for our customers shopping online and intervenes when they are making a purchase with a suspect retailer.”

Overseas online retailers are dynamically added and removed from Westpac’s high-risk lists based on analysis of transaction patterns and merchant behaviours as well as previous reports from its customers.

Westpac encouraged its customers to remain vigilant when shopping online and to contact the bank as soon as possible if they believe they have fallen victim to a scam.

“While scams are getting more sophisticated, so are the banks at detecting them, and we want scammers to know we are watching and taking action to protect our customers,” added Mr Young.

The Australian Competition and Consumer Commission (ACCC) has warned Aussies who have fallen victim to scams to remain vigilant about further attempts to steal their money.

Money recovery scams, where scammers offer to help victims recover money if they pay an initial fee, have spiked to 725 per cent so far this year according to the consumer watchdog.

“Scammers will ask for money and personal information before offering to ‘help’ the victim and will then disappear and stop all contact,” said ACCC deputy chair Delia Rickard.

“Money recovery scams are particularly nasty as they target scam victims again. These scams can lead to significant psychological distress as many of the people have already lost money or identity information.”

About 66 reports have been received by the ACCC this year with losses totalling over $270,000.

The consumer watchdog explained that money recovery scams typically involve scam victims receiving an uninvited offer of assistance from what appears to be a trusted organisation such as a law firm, fraud taskforce or government agency.

Victims are asked to make an advanced payment to the scammer and may be requested to fill out fake paperwork, provide identity documents or give access to their computer or phone.

The ACCC said that scammers may also target individuals who have not previously fallen victim to a scam by convincing them otherwise and then claiming they are entitled to a settlement refund.

“If you get contacted out of the blue by someone offering to help recover scam losses for a fee, it is a scam. Hang up the phone, delete the email and ignore any further contacts,” said Ms Rickard.

“Don’t give financial details or copies of identity documents to anyone who you’ve never met in person and never give strangers remote access to your devices.”

Anyone who has lost money to a money recovery scam or any other type of scam should contact their bank or financial institution as soon as possible.

By reporting the scam, the ACCC said that institutions may be able to identify where the money was sent and block the accounts associated with scammers, potentially preventing others from also sending money to these accounts.

The Australian Financial Complaints Authority (AFCA) is also able to provide a dispute resolution service for scam victims who are not satisfied with the response of their financial institution.

One in nine people suffered card fraud, scams or another form of personal fraud during the last financial year.

New data from the Australian Bureau of Statistics (ABS) has shown that 2.1 million Aussies fell victim to one or more types of personal fraud in the 2020-21 financial year.

An increase in card fraud and scams resulted in 11 per cent of the population experiencing at least one form of personal fraud during the financial year, up from 8.5 per cent in 2014-15.

Card fraud was found to be the most common type of fraud, affecting 6.9 per cent of individuals aged 15 and older or around 1.4 million people in total.

An even higher percentage of Aussies aged between 35 to 44 (9.1 per cent), 45 to 54 (9.0 per cent) and 55 to 64 (8.1 per cent) fell victim to card fraud than those in other age groups.

In approximately one-third of incidents, victims said that their card details had been obtained over the internet, while 39 per cent did not know how their details were obtained.

95 per cent of the individuals who experienced card fraud reported the latest incident to an authority, including their bank or financial institution (88.7 per cent) or credit card company (15.3 per cent).

Meanwhile, more than 723,000 people or 3.6 per cent of the population experienced some type of scam during 2020-21, up from 2.4 per cent in 2014-15.

“Since 2014-15, victimisation rates have increased for information request or phishing scams , buying or selling scams and upfront payment scams,” said ABS director of the National Centre for Crime and Justice Statistics Will Milne.

The percentage of Aussies who experienced an information request or phishing scam during 2020-21 more than doubled to 1 per cent.

Additionally, 0.8 per cent of people fell victim to a buying or selling scam, 0.4 per cent were hit by an upfront payment scam and another 0.4 per cent were duped by a financial advice scam.

The 45 to 54 age bracket had the highest rate of scam victimisation at 4.2 per cent, followed by the 65 and over age group (4.0 per cent) and those aged between 35 to 44 (3.9 per cent).

Unlike the high levels of reporting seen for card fraud, only half of those who had experienced a scam reported the most serious incident to an authority.

“The reporting rate varied by scam type, ranging from 23 per cent for computer support scams to 65 per cent for buying or selling scams,” said Mr Milne.

The ABS found that an estimated 55 per cent of Aussies, or about 11.1 million people, had encountered a scam during the 2020-21 financial year, most commonly over the phone (38.3 per cent), via email (32.2 per cent), text message (23.4 per cent) or online (20.2 per cent).
