Former students might want to think carefully before they look to take advantage of the federal government’s biggest first home buyer incentive.

If you’re a first-time home buyer with an outstanding HECS debt, you might be setting yourself up for a tax surprise.

CPA Australia senior manager of tax policy Elinor Kasapidis told nestegg that First Home Super Saver Scheme (FHSSS) amounts are taxed at the time they’re withdrawn to pay for a property purchase.

“This means that the deposited amount plus earnings will be added to the first home buyer’s taxable income for that financial year,” she said.

While the current maximum FHSSS contribution is $30,000, the government has flagged an increase to $50,000 in the future.

Ms Kasapidis said that this amount would be enough to push many taxpayers into a higher marginal tax rate, which could, in turn, increase their HELP repayments.

“This could lead to an unpleasant surprise when the tax bill comes,” she said.

Ultimately, Ms Kasapidis said that the FHSSS shouldn’t be treated any differently to any other financial agreement.

She recommended that consumers always read and make sure they understand the fine print of government programs to avoid unexpected liabilities.

“A tax agent can help you understand the tax consequences of participating in the FHSSS, including potential tax liabilities when you withdraw your FHSSS amounts,” she said.

Research recently released by Homeloanexperts.com.au earlier this year asserted that a majority of millennials believe that the housing market needs more regulation in order to slow housing price growth and entice more first home buyers into the market.

A further 40 per cent of those surveyed said that these new measures should look to target first home buyers directly, akin to the government’s First Home Super Saver Scheme.

In the absence of affordability, Homeloanexperts.com.au chief executive Alan Hemmings said millennials are looking to find new ways into the market.

“Whether this involves them delaying their purchase, turning to family members to act as guarantor or even considering other options like rentvesting, millennials are being forced to consider other methods in their property journey,” he said.

Social services sector advocates have warned that further tax cuts may make solving Australia’s biggest challenges much harder.

The Australian Council of Social Services (ACOSS) and its member organisations have called on both of Australia’s major parties to rethink the long-term consequences of recent tax cuts.

ACOSS CEO Dr Cassandra Goldie said that both recent challenges like the COVID-19 pandemic and the Black Summer bushfires and looming ones like climate change and Australia’s aging population called for a government armed with the revenue needed to act and produce solutions to big problems.

“We call on our political leaders to guarantee that if they win government, they will raise the resources needed to meet these challenges and properly fund essential services and income supports rather than cutting them back,” she said.

Pointing to the disparity between Australia’s status as one of the wealthiest countries in the world when measured by median household wealth and the fact that it has one of the lowest levels of social expenditure in the OECD, Dr Goldie slammed the commitments of both the Liberal and Labor parties to “unaffordable” income tax cuts.

“Responsible government is not small or passive government. We cannot afford a contest over who can offer bigger tax cuts,” she said.

According to the 2021 budget papers, federal government expenditure per person will fall by an average of 0.7 per cent each year from 2022 as new tax cuts kick in.

In a statement, ACOSS also advocated for the rescinding of new tax cuts for those on higher incomes, the shielding of those on the lowest from the effects of spending cuts and a fully-fledged review of the tax system itself.

The organisation argued that this overhaul would help strengthen revenues, improve fairness within the system and eliminate socially harmful tax concessions like fossil fuel subsidies.

Dr Goldie cited the effectiveness of costly-but-effective policy measures like the COVID supplement and argued that more such measures might be needed in the future.

“Poverty was halved when the COVID supplement was available, over 700,000 jobs were saved, child care was affordable and people sleeping on the streets were housed,” she said.

“We must now confront persistent poverty and inequality, an ageing population, the spread of mental illness and domestic violence, and the catastrophic threat of climate change. The next government cannot do these things with the resources available to it.”

Reforms to Australia’s telecommunication intercept laws could see Australia's tax man granted the ability to listen in on the conversations of taxpayers.

Speaking on the release of a public discussion paper outlining the government’s plans to update domestic surveillance laws, federal Minister for Home Affairs Karen Andrews was adamant that the measures would strike the right balance.

“The government will balance the need for agencies to have the powers they require to protect Australians, while ensuring these powers are subject to robust controls, safeguards and oversight,” she said.

A key reform proposed by the discussion paper includes the broadening out of electronic surveillance mechanisms to new government bodies with a “clear and compelling” case for accessing them.

The list of potential beneficiaries of this includes both the Australian Transaction Reports and Analysis Centre (AUSTRAC) and the Australian Taxation Office (ATO).

For the former, the government argued that the power to intercept telecommunications data could play a valuable role in AUSTRAC’s mission to deter money laundering and financing of terrorism.

In contrast, the argument for the ATO having access to the data is more defensively oriented.

“With respect to the ATO, access to telecommunications data would support or, in some cases, potentially replace expensive, resource-intensive and intrusive physical surveillance operations,” the discussion paper said.

“ATO experience demonstrates that telecommunications data would also be a critical tool in excluding non-involved individuals from lines of inquiry, or in establishing a relationship between an original person of interest being investigated (for example, for tax fraud) and a larger group of individuals committing serious criminal offences (such as large-scale fraud against the Commonwealth).”

Ms Andrews said that the proposed reforms will better protect individuals’ information and data, and ensure law enforcement and security agencies have the powers they need.

“Australians can trust the Morrison government to deliver legislation that is clear, fit-for-purpose, proportionate and enduring, and that will keep Australians safe and protect our way of life,” she said.

As the economy recovers, Australia’s tax regulator says it’s planning to put unregistered practitioners under the microscope.

The stats suggest that the tax tribulations of the pandemic drove more businesses and consumers to rely on Australia’s Tax Practitioners Board (TPB).

According to the latest report by the regulator, the challenges of the last 12 months only brought tax practitioners and taxpayers closer together.

“As Australia and the world continued to grapple with the ongoing implications of the coronavirus pandemic, we also continued to ensure that tax practitioners were enabled to provide quality and ethical taxation services while maintaining the high levels of trust placed in them by their clients, the Australian public,” TPB chair Ian Klug said.

Over the past 12 months, the TPB said that it reviewed 170 cases of potential misconduct. Seventy-five of these investigations resulted in the termination of a practitioner’s registration.

He noted that annual TPB register searches exceeded 2 million for the first time in the 2020–2021 financial year.

In addition to these queries, TPB staff answered around 20,000 emails and letters and approximately 29,000 telephone enquiries.

Mr Klug suggested the growth in the usage of the TPB as a resource mirrors the increase in consumer and business awareness of the organisation.

He noted that 80 per cent of business owners are not aware of the tax regulator, up on 67.7 per cent in December 2020.

Consumer awareness of the TPB has also risen in recent months from 38.5 per cent in December 2020 up to 57.7 per cent in July 2021.

Looking forward, Mr Klug called the federal government’s recent response to the independent review into the effectiveness of the TPB and the Tax Agent Services Act 2009 a “positive step forward for the future”.

“In line with the review recommendations, we are working to finalise our memorandum of understanding with the ATO and formalise our data‑sharing arrangements with various agencies and stakeholders,” he said.

Mr Klug also indicated that the TPB would be looking to focus more on unregistered preparers in the coming year.

“We continue to invest in and improve on our data analytics capabilities to drive our compliance work, investigating those practitioners who choose to do the wrong thing, while supporting the majority that continue to uphold the high expectations of the profession and the integrity of our tax system,” he said.

The average tax rate paid by Australians could rise to 25.5 per cent by 2031–32 due to bracket creep, according to a new report by the Parliamentary Budget Office.

This compares to the average tax rate of 23.5 per cent expected for the 2021–22 financial year.

Bracket creep occurs where an individual moves into a higher tax bracket due to rising income, increasing the average amount of tax they pay even when tax brackets and rates remain unchanged.

Previously, the first two stages of the federal government’s personal income tax cuts saw a reduction in the average tax rate between 2017–18 to 2020–21, but the PBO anticipated that the average tax rate will go back to 2017–18 levels in 2023–24.

“Average tax rates will decline again in 2024–25 with the Stage 3 tax cuts but are projected to rise to 25.5 per cent by 2031–32 if there are no further personal tax policy changes,” the PBO said.

“This would be a level not seen since before the introduction of the GST in 2000.”

The PBO said that bracket creep is projected to play a key role in the government’s budget recovery over the next decade. While tax cuts in 2031–32 are expected to cost just over $30 billion, bracket creep will generate $57 billion in additional revenue for the government.

“Outside periods of budget repair, governments have periodically increased tax thresholds or lowered tax rates, with the effect of reducing or even reversing the impact of bracket creep — this is referred to as ‘returning’ bracket creep,” the PBO report explained.

This has led to the average personal income tax rate remaining between 22 and 25 per cent for the majority of the past four decades.

“Governments face a trade-off between returning bracket creep and allowing bracket creep to reduce debt faster,” the PBO noted.

The 31 October deadline for tax return self-lodgement is fast approaching, and you may be wondering if there is anything you can do to reduce your tax liabilities for the 2020–21 financial year.

Platinum Accounting Australia managing director Coco Hou has put together a list of her top 10 tips to consider now and in the future.

“Whether you are an individual, side-gigger, solopreneur, business owner, freelancer, start-up or larger business, there are some key things that you should do prepare yourself for tax time that will help to reduce the amount of money you have to hand over to the ATO come tax time,” Ms Hou said.

Record your work-related expenses

Ms Hou said that individuals need to “be ruthless” and keep track of all work-related expenses throughout the year, making sure to keep hold of receipts.

“Take photos of your receipts using apps like Hubdoc that integrate with cloud-based accounting systems such as Xero. These apps convert your receipts into data that is then uploaded straight into your accounting system,” suggested Ms Hou.

Make tax-deductible donations

You can show your support for a cause by making a tax-deductible donation to a charitable organisation.

“For a donation to be tax-deductible, it must be made to an organisation endorsed as a Deductible Gift Recipient (DGR) and must be a genuine gift,” Ms Hou said.

Make extra contributions to your super

Additional payments can be made to your superannuation that will be taxed at 15 per cent. However, Ms Hou said individuals should take note of the cap on concessional contributions that is currently set at $27,500 per financial year.

Claim investment expenses

“Remember to claim investment expenses and your investment loss from the prior year, as this can be carried forward to offset future gain,” she noted.

Use a quantity surveyor

By using a quantity surveyor to prepare a depreciation schedule for your rental property, you can ensure depreciation is captured and included in your tax return.

“A tax depreciation schedule is 100 per cent tax-deductible. This means you can claim the fee charged by the quantity surveyor as part of your tax return.”

Pay interest on time

Ms Hou also highlighted the importance of ensuring loan repayments are made on time.

Utilise the capital gains discount

The 50 per cent discount on capital gains can be used for assets you have held for at least one year, including cryptocurrencies.

“For people who invest in crypto, if you’ve had the crypto for more than 12 months, you may be eligible to discount your capital gain by 50 per cent,” she said.

Structure your assets

Individuals should explore the use of different structures, such as a family trust, to better manage their assets and distribution of income.

Hold private health insurance

“Having private health insurance coverage means you avoid having to pay the Medicare levy surcharge,” she said.

Tax-plan with your accountant

“Maintain communication with your accountant and ensure you undertake a tax planning session once a year. This will help you to plan for the future and ensure that you have identified all the opportunities to minimise your tax bill at the end of the year,” concluded Ms Hou.
